2. ISI is merely providing you an "on-ramp" or connection to the Internet. You hereby acknowledge that the Internet is not owned, operated, managed by or in any way affiliated with ISI or any of its affiliates, and that the Internet is a separate network of computers independent of ISI's network. Your use of the Internet is solely at your own risk and is subject to all applicable local, state, national and international laws and regulations. The services being provided hereunder are on an as is, as available basis and ISI expressly denies any responsibility or liability for any disruptions in service. |

3. ISI network may only be used for lawful purposes. Transmission of any material in violation of the United States or State regulations is strictly prohibited. This includes, but is not limited to, copyrighted material, material legally judged to be threatening or obscene, trade secrets and trademarked information, proprietary material, and cryptographic software subject to US exportation restrictions. |

4. ISI is not obligated to monitor its network; however, ISI may monitor its network and subscriber activity and disclose such information gained in order to comply with law, regulation, or government investigation, or to protect its Services or subscribers. ISI reserves the unilateral right to refuse to post, remove, or restrict access to, any information or materials, in whole or in part, that in its sole discretion are unacceptable, undesirable, or in violation of this agreement. |

5. ISI provides access to many other networks for which ISI exercises no control over. However, you agree to comply with all Policies for any network which your information may traverse to include compliance with all Federal, State, and local laws. |

6. ISI reserves the right to cancel your account without cause and without notice. |

| 7. You declare that you are a legal adult at least 18 years of age. |

8. Access to ISI's network or services may not be redistributed, resold, or granted to any other entity, business, or individual without the express written permission from ISI. |

9. Dial-up, ISDN, and Web hosting subscribers are entitled to a single login account. Subscriber acknowledges that the security of your account and password is exclusively under your control and that the consequences of access obtained by any other individual either by purpose, accident, or through your own negligence, is solely your responsibility. You further agree to hold harmless ISI, its officers, and affiliates from any damages no matter how consequential arising from breach of this agreement and acknowledge that disclosure of your login password is fraudulent and may result in criminal or civil prosecution. |

10. All (non-dedicated) accounts include 24-hour "Interactive" unlimited access to ISI's network and connected network. Non-dedicated accounts are for interactive use only. The use of electronic mail (e-mail) checkers, ping-daemons, personal web servers, or any other software or procedures for the reason of keeping a connection alive in the absence of human interaction is a violation of our usage policy and will result in the automatic upgrade of the customer account to dedicated connection at monthly flat rate of sixty dollars ($60) for Dial-Up, or one hundred twenty dollars ($120) for ISDN. |

11. Unsolicited commercial or bulk E-Mailing is strictly prohibited. You may not use ISI E-Mail services to conduct any form of unsolicited advertising, promotion, or sale of goods or services without the express written consent of ISI. Bulk E-Mail messaging to more than 20 recipients per day or more than 120 per week is also prohibited. |

12. ISI reserves the right to amend these Terms and Conditions at any time, as well as services being offered. Notification of revised terms through E-mail or posting such notifications on this Website shall constitute sufficient notice. |

13. You acknowledge that neither the Internet nor ISIs network is secure. Although ISI will take reasonable security precautions (i.e. password protected accounts, router filtering, server firewall rules) to protect it's network, this does not constitute a secure network and that no expectation of security or privacy is offered or implied. |

14. Any use of ISI's services to probe or gain unauthorized access to other computers or computer networks, or to engage in malicious activity is strictly prohibited and may be a violation of law. This includes any intentional or unintentional act resulting in disrupting Internet services, transmission of viral programs, E-mail bombs, posting of inappropriate, threatening, or offensive mail to newsgroups, E-mail list servers, commercial or individual accounts as well as disseminating information on how to perform these and other related acts. |
